SPECIAL COMMITTEE NO. 06
No.PAP/Legis-1(19)/2024/139. In exercise of all the powers enabling him in this behalf and pursuant to the mandate granted by the House during the sitting held on September 09, 2024, Mr Speaker has been pleased to constitute Special Committee No. 06 in terms of rule 187 of the Rules of Procedure of the Provincial Assembly of the Punjab 1997, to consider the issue raised in Adjournment Motion No. 195/2024 moved by Mr Amjad Ali Javed, MPA (PP-121) comprising the following:

2. The TORs of Special Committee shall be as under:
i) Examination of Lease Terms: Review the legality, appropriateness, and public interest of the current lease agreement between Lahore Gymkhana Club and the Punjab Government. Especially, consider whether the Lease complies with superior court judgments, particularly those of the Supreme Court, on state land leases.
ii) Lease Agreement Compliance: Review the 1960 and 1996 lease agreements (“the Lease Agreements”) for legality, compliance, and appropriateness, particularly the 50-year lease duration and terms.
iii) Public Purpose and Land Use: Investigate the government's right, under the Lease Agreements, to resume the land for public purposes, such as converting it into a park, urban forest, or other equitable land uses.
iv) Compliance with 2023 Notification: Assess whether Lahore Gymkhana is paying rent according to the 10th May 2023 Colonies Department notification (10% of market rent) and whether the lease violates the 15-year limit.
v) Unauthorized Permanent Structures: Examine if any permanent structures were built on the leased land without prior government approval, as per lease terms.
vi) Environmental and Sustainable Use: Evaluate the feasibility of converting Gymkhana’s green spaces into urban forests, given Lahore’s water scarcity and pollution.
vii) Financial Loss and Recovery: Investigate any financial losses due to undervalued rent and recommend recovery measures from responsible parties.
viii) Exclusive Use of Public Land: Review the legality of Lahore Gymkhana’s exclusive use of public land, including the 3.5-acre cricket ground in Bagh-e-Jinnah, Lahore.
ix) Membership Criteria: Examine the criteria for awarding membership at Lahore Gymkhana, ensuring transparency and fairness.
3. The Committee may hold open hearings and may engage experts for well-informed deliberations.
4. The Special Committee may co-opt any other Member of Provincial Assembly of the Punjab whom it may consider necessary for discharge of its functions.
5. The Committee shall submit its report to the Assembly, within a period of two months, detailing the findings of its investigation. The report shall include recommendations for policy changes, lease renegotiations, potential alternate land uses, and improved governance and transparency mechanisms for state land leases. The Committee shall recommend actions to ensure accountability for any wrongdoing identified during the inquiry.
